Acceptance of Terms
The services that ‘Download T-Shirt Designs’ provides to you are subject to the following Terms and Conditions. ‘Download T-Shirt Designs’ reserves the right to update the Terms and Conditions at any time without notice to you. Your use of the ‘Download T-Shirt Designs’ web site and services signifies that you agree to and are bound by these Terms and Conditions set forth in this document.
Description of Services
‘Download T-Shirt Designs’, offers for sale: downloadable, professionally designed graphic designs. “Designs” includes but is not limited to original and/or modified graphics, images, designs, illustrations and digital files. “You” means the purchaser of designs from us.“We”,“us” and “our” means ‘Download T-Shirt Designs’.
Pricing
All prices displayed on the website are in USD (United States Dollars). Prices are subject to change without notice. Each graphic is for sale with ‘Non-Exclusive Use’. This means once purchased you have the non-exclusive right to reproduce the graphic(s) on any product(s) in any quantity for 12 months.
Permitted Uses & Time Frame
Once purchased you have the right to reproduce by printing, DTG [Direct To Garment] printing, screen printing or any other method of applying our Designs on your product(s) in any quantity for a 12 month period from the time of purchase.
You may keep your products on sale after the 12 month period from the time of purchase but you may not reproduce the purchased Design(s) after 12 months from the purchase date. You must also stop all advertising & promoting the design after 12 months. You do have the option to purchase the rights for another 12 months. After 12 months you will be notified that your time is up & you will have the option to purchase another 12 months of rights.
All purchased Designs are under the copyright protection of ‘Download T-Shirt Designs’. Purchased Designs are potentially sold more than once after the 12 month period had passed from the time you purchased the Designs. By completing a purchase, you accept that ‘Download T-Shirt Designs’ has the full discretion to decide how many times the Designs are resold to the purchasing clientele.
All of our downloadable Designs are Royalty Free. This means that once purchased you do not have to pay royalties on the Designs when you print them on your products.
You may use any Design(s) purchased from the ‘Download T-Shirt Designs’ website including, but not limited to the following purposes:
Screen prints, digital prints and reproductions in any quantity for clothing lines or brands;
Advertising and promotional collateral and printed materials;
Online or electronic publications, including web pages.
You may change the colours, add text, modify the design if you have the skills and toolset to do so. You may not resell the design even if you have modified it.
You may transfer files containing the Designs to your clients or other third parties for the purpose of reproduction, provided that such parties shall have no further rights to use the Designs for profit. It is the purchaser’s responsibility to ensure the Design(s) do not break local trademarks and copyright laws. This includes any words or elements. ‘Download T-Shirt Designs’ holds no responsibility for legal action taken against the purchaser breaching local laws.
Prohibited Uses
You may not provide a copy of Designs, or any part thereof, to any person or legal entity or allow any person or legal entity to obtain access to the Designs, or any part thereof, except as expressly permitted above. You must not use any of the Designs including but not limited to the following manner:
(a) resell, share with your friends, colleagues, give away, repackage, or redistribute any Design in any way, for free.
(b) make available the original source files for download or resale.
(c) use any Design in a manner that may be considered to be pornographic, obscene, defamatory or libelous in nature;
(d) use any Design in a manner which depicts a person in a potentially sensitive subject matter;
(e) sub-license, sell, rent, lend, or otherwise distribute any Design;
(f) post a copy of any Design on a network server or web server for use by other users; or
(g) transfer the rights to any Design or accompanying materials, except as specifically provided for in these Terms and Conditions.
You must also stop all advertising & promoting the design after 12 months. You do have the option to purchase the rights for another 12 months. After 12 months you will be notified that your time is up & you will have the option to purchase another 12 months of rights.
Intellectual Property Rights
You do not own the Intellectual Property Rights on any of the Designs that you purchase from us. ‘Download T-Shirt Designs’ &/or the Design creator retains the full Intellectual Property Rights on the designs that they created.
All content included on this site, such as text, designs, logos, button icons, images, digital downloads, data compilations, and software, is the property of ‘Download T-Shirt Designs’ or its content suppliers and protected by the Australian Copyright Act (Cth) 1968 and international copyright laws.
You should be aware that it is illegal to reproduce or distribute copyrighted material without the permission of the copyright owner. Only the copyright owner, or the owner’s legal agent, can give you permission to copy, distribute, or publicly display protected material. You do not own the copyright when purchasing items from the ‘Download T-Shirt Designs’ website.
Product Delivery
All ‘Download T-Shirt Designs’ Designs are digital files delivered through the ‘Download T-Shirt Designs’ website via links provided to the client. ‘Download T-Shirt Designs’ does not ship out physical goods such as CD’s or other form of storage media. By purchasing a ‘Download T-Shirt Designs’ Designs, you agree that your order will be processed automatically and:
1. The download links will be active immediately for a period of 30 days.
2. ‘Download T-Shirt Designs’ may refund any potentially fraudulent purchase.
3. ‘Download T-Shirt Designs’ representatives may contact you if there is a problem with your account.
All files are saved as a .png file type. (Portable Network Graphic) All designs are high resolution (300dpi) & are on a transparent background so that you can print them onto any background colour that you choose to. (The background color is not included in file. To open .png files, here’s a list of popular programs: Adobe Photoshop, Adobe Illustrator, Adobe Acrobat, Adobe InDesign, Apple Preview, Corel PhotoPaint, CorelDRAW, Fireworks, Microsoft Explorer, Microsoft Photo Viewer, GIMP, QuarkXpress + more.
Your Account
‘Download T-Shirt Designs’ shall not be responsible for ensuring the accuracy of information of your account and therefore shall not be held liable for any losses sustained as a result of the incorrect information provided. ‘Download T-Shirt Designs’ shall also not responsible for maintaining confidentiality and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.
Warranties
‘Download T-Shirt Designs’ warrants that it reasonably believes it has not infringed or misappropriated third party intellectual property rights in this jurisdiction or internationally.
Warranty Exclusions
‘Download T-Shirt Designs’ will not be liable for infringements of patents, trademarks, copyrights, other proprietary and/or intellectual rights arising out of misrepresentation or negligence or any use of the Designs by you.
‘Download T-Shirt Designs’ warrants that those aspects of access to, or use of, the services provided which are within its exclusive control will be fit for reasonable performance. ‘Download T-Shirt Designs’ cannot warrant and shall not be liable for those aspects of access to, or use of the services provided over which ‘Download T-Shirt Designs’ does not have exclusive control. ‘Download T-Shirt Designs’ shall not be liable for the following including but not limited to: Problems and/or losses arising from malfunction of telephone networks or lines; computer on-line systems; services or providers (including but not limited to internet service providers; application service providers and content delivery networks); computer equipment or software, viruses, bugs or software or hardware configurations; Internet or any website or any combination thereof;
• Damage to your system occasioned by use of the site; and
• Internet connection speed, access errors, interruptions of access and download quality of the images;
‘Download T-Shirt Designs’ will not be liable for any business or legal decisions, actions or omissions taken by you based on your choice of Designs and no representations made by ‘Download T-Shirt Designs’ about the market appeal or sale-ability of any products on which you may reproduce the Designs.
It is your responsibility to ensure that any of the above problems are rectified within 30 days and ‘Download T-Shirt Designs’ does not promise that it can or will extend the 30 day period for download of the Designs.
Entire Agreement
These Terms and Conditions sets out the entire agreement and understanding between the parties and supersedes all prior agreements, understandings or arrangements (oral or written) in respect of the subject matter of these Terms and Conditions and these Terms and Conditions prevail to the extent of any inconsistencies with your order and terms you seek to impose in any order.
Refunds
We don’t give refunds after you have downloaded the design. Since ‘Download T-Shirt Designs’ Designs are all digital files and there are no means of any actual goods being returned to ‘Download T-Shirt Designs’ with the guarantee that the delivered files have been destroyed, therefore all sales are considered to be final and non-refundable once the client has activated the download links. If the file you download is not the correct design, if the file is corrupt or contains an error, please contact us immediately and we will fix the issue so that you can download a problem free file as purchased.
